Terms of service

Terms of Service

Last updated: 27 September 2026

These terms are the agreement between you and Muksun, LLC, a Nevada limited liability company — "Muksun Games", "we", "us". They cover muksungames.com, the Muksun Games app, the game brief, and every game we make for you.

By ordering a game, creating an account or using the app, you accept these terms. If you do not accept them, please do not order.

Three sections are worth reading even if you skip the rest: section 7, about bugs and why you should play your game before you give it to anyone; section 9, about the photos and personal details you send us; and section 10, about what we reuse from the games we build.

1. Who can order

You must be at least 18 to buy a game. You may use the app from age 13; between 13 and 17 you need a parent or guardian's permission, and they accept these terms with you. Under 13, a parent or guardian must set up and run the account.

You must give us accurate information, and keep your account password to yourself. Tell us at support@muksungames.com if you think someone else has got into your account.

2. What we make

We build custom video games starring real people. Each order is made by hand to your brief. Editions, hero counts, worlds, delivery speeds and prices are shown on the product page, and those are the terms of your order.

A custom game is a creative commission, not a manufactured product. We will follow your brief as closely as we can, but the art style, level design, humour and the way your characters are drawn are ours to interpret. We show examples on our site so you can see the style before you buy.

3. Prices and payment

Prices are in US dollars and are shown on the site. Tax is added where required. Payment is taken in full at checkout — we start work after we have both your payment and your completed brief.

Prices inside the app may be higher than on the website, because the app stores take a share. Purchases made in the app are processed by Apple or Google under their terms, and refunds for those purchases follow their rules, not ours.

We can change prices at any time, but never for an order you have already placed. If a price on our site is obviously wrong, we may cancel the order and refund you in full rather than honour the mistake.

4. The brief

After you pay, we send you a link to the game brief. This is where you tell us who the game is about and upload the photographs.

The clock starts when the brief is complete, not when you pay. We cannot begin without the photos and details, so delivery times are counted from the moment we have everything we need. If your brief is missing something, we will ask; each round of back-and-forth adds to the time.

Please send clear, well-lit photographs showing the person's face. Poor photographs make for poor characters, and we may ask for better ones.

If we have not received your brief within 90 days of your order, we may treat the order as abandoned and close it without a refund. We will email you at least twice before doing that.

5. Delivery

Games are delivered digitally — through the Muksun Games app, or by a download link, depending on the platform.

Delivery times are shown on the product page and depend on the edition you choose and whether you add rush delivery. They are counted in days from the completion of your brief, and they are estimates made in good faith, not guarantees. We will tell you as soon as we know if something will be late.

If you are ordering for a specific date, add rush delivery and order with room to spare. If we miss a date you told us about and the delay is our fault, contact us and we will make it right — a refund of the rush fee at a minimum.

We support games on the platforms listed on the product page at the time you order. We cannot promise a game will run on every device, on future operating system versions, or after an app store changes its rules.

6. Changes and revisions

Once production begins we cannot rework the game from scratch, but we do want you to be happy with it.

  • Before production starts, you can change your brief freely — just email us.
  • After delivery, we will fix our mistakes at no charge: a misspelled name, the wrong catchphrase on the wrong character, a character built from the wrong photo, or a bug that stops you playing. Tell us within 14 days of delivery.
  • Changes of mind — a different world, a new character, a different joke — are new work, and we will quote for them.

7. Bugs, and testing your game before you give it

Please read this one before you order.

Your game is not a mass-produced product that has been through months of testing on thousands of machines. It is a one-off, built from scratch for you, in days, by hand. Every order has new art, new characters, new text and new level tweaks that have never existed before and will never be built the same way again. That means bugs and glitches are possible, and sometimes likely — a character that walks oddly, a line of text that runs off the edge, a level that behaves strangely on a particular device, a crash. We test every game before we send it, but we cannot test every device, every screen size and every combination.

You need to play the game yourself before you give it to anyone. Play it all the way through, on the device the recipient will use if you can. If something is wrong, tell us — email support@muksungames.com with what happened, where in the game, and on which device, and a screenshot or short clip if you can manage one. We will fix it. Leave yourself time to do this before the birthday, the anniversary or the proposal; if the date is tight, add rush delivery and order early.

A bug is a thing for us to fix, not a reason for a refund. By ordering you accept that a handmade, one-off game may have faults, that you will tell us about them, and that you will give us a fair chance to put them right. We are not responsible for a spoiled moment if you handed the game over without playing it first, or if you found a problem and did not tell us.

If we cannot fix it, we refund you. If you report a fault that genuinely stops the game from working and we cannot repair it in a reasonable time, we will tell you so plainly rather than leave you waiting — and at that point we refund you in full. We would rather say "we could not do it" and give your money back than pretend otherwise.

Nothing in this section takes away rights you have under consumer law that cannot be excluded by agreement.

8. Cancellations and refunds

Before we start production — that is, before we begin drawing your characters — you can cancel for a full refund. Email support@muksungames.com.

Once production has started, the work is personalised to you and cannot be resold, so sales are final. This is why we ask you to look at the examples on our site before you buy.

If the game has a fault, section 7 applies: tell us, we fix it, and if we cannot fix it we refund you in full.

If you are a consumer in the UK or EU, you normally have 14 days to change your mind about a digital purchase. That right does not apply to goods made to your specification, which is what a custom game is; and where it would otherwise apply to the download, you agree that we may begin supplying immediately and you acknowledge that you lose the right to cancel once we have. Nothing in these terms removes rights you have under mandatory consumer law.

9. The photos and details you send us

9.1 What you are promising us

When you upload a photograph or write something into the brief, you are telling us all of the following, and we rely on it:

  • It is yours to give — you own it, or you have permission from whoever does.
  • Every identifiable person in it has agreed to be in a video game. You have asked them. If it is a surprise gift and you cannot ask without spoiling it, you are taking responsibility for them being fine with it.
  • If anyone in it is a child, you are their parent or legal guardian, or you have that parent or guardian's permission.
  • It does not infringe anyone's copyright, trademark or other rights — no photos taken by a professional photographer whose contract forbids it, no film stills, no characters from other games or films.
  • It is not illegal, hateful, harassing, sexual, or intended to humiliate the person in it.

If any of that turns out not to be true, we may stop work, refuse to deliver and close the order without a refund. If someone brings a claim against us because of something you sent, you agree to cover our costs, as set out in section 16.

9.2 The permission you give us

You give us a worldwide, royalty-free licence to use, copy, edit, adapt and incorporate what you send us — photographs, names, likenesses, catchphrases, stories and details — for the purpose of building, delivering, supporting, fixing and rebuilding your game, and for keeping our records. That licence lasts as long as we hold the material under our Privacy Policy.

That is the whole of it. It does not let us put your photographs into anyone else's game, into a game we publish, or into our advertising. For that we ask you separately — see section 11.

10. What we own, and what we reuse

10.1 Our library

Every game we make is assembled from a large body of material that belongs to us and that we have built up over years:

  • the game engine, source code, tools and the Muksun Games app;
  • worlds and themes — Zombie Apocalypse, Haunted Castle, Winter, Interspace, K-pop Slayers, hometown settings and any others we create;
  • levels and level layouts, backgrounds, tiles, props, buildings, vehicles and scenery;
  • enemies, bosses, non-player characters and the generic pixel characters we draw;
  • animations, rigs, physics, gameplay mechanics, power-ups, weapons, scoring and difficulty systems;
  • user interface art, icons, fonts, effects, music, sound effects and voice work;
  • our name, logo, artwork, website, photography and copy.

All of it stays ours, along with the copyright, trademarks and every other right in it. Buying a game gives you a licence to play it. It does not transfer ownership of any of the pieces it is made from, and it is not work made for hire.

10.2 We reuse it, and you agree to that

We reuse everything in that library, freely and without limit. The world you pick will appear in other people's games. An enemy we drew while working on your order may turn up in a game we build next year. A level we designed for you may be adapted, improved and used again — in custom games for other customers, in games we publish and sell ourselves, in demos, templates, tutorials and marketing.

This applies whether or not a given piece was first created while we were working on your order, and whether or not the idea for it came from your brief. You are not owed further permission, credit, royalties or payment for any of it, and you waive any moral rights you might otherwise assert in it.

We may also keep a de-personalised version of your game — the same levels, layout and design with your photographs, names, likenesses and personal details stripped out and replaced with generic ones — and reuse that as a template for other customers or for games of our own.

Ideas, feedback and suggestions you send us are ours to use however we like, with nothing owed to you.

10.3 What we do not reuse

Your personal content is not part of our library, and it stays out of other people's games and out of anything we publish. Specifically, we will not reuse:

  • photographs you upload, or any face, portrait or character sprite generated from a real person's photograph;
  • the names, nicknames, catchphrases, voices and likenesses of you or the people in your game;
  • your hometown address and the recognisable, private details of the place you live;
  • the inside jokes, memories, messages, dates and story you gave us in the brief;
  • your finished, personalised game as a whole.

Where a character was modelled on a real person, the rig, the animation, the clothing, the walk cycle and the art around it are ours and get reused. The face, the name and anything else that identifies that person stay with your game.

10.4 Your licence to play

Your game is licensed to you, not sold. You get a personal, non-exclusive, non-transferable, worldwide licence to install and play it for your own private, non-commercial enjoyment, and to let your household and the people in the game play it too.

You may not sell it, rent it, sublicense it, publish it to an app store or game platform, or distribute copies. You may not decompile, reverse-engineer or extract the art, code, music or assets from it, except where the law says you may despite a term like this one.

You can share it socially. Streaming your game, posting clips, and showing it to people is fine and encouraged, as long as you are not charging for access to it.

11. Showing your game to other people

The best advertising we have is a real person's real reaction. We would love to use yours — a clip of the game, a screenshot, a photo of the moment someone opened it.

We will only do that if you tell us we may. We ask separately, in writing, and a "no" costs you nothing. If you say yes and later change your mind, email us and we will stop using it going forward — though we cannot recall material already printed, already served as an ad, or already reshared by other people.

12. The app

The Muksun Games app is licensed to you, not sold, on the same basis as section 10.4. You need an account, and the games you have bought — on the website or in the app — appear in the library for that account.

We may update the app, change how it works, or stop supporting old versions and old devices. We will give reasonable notice before withdrawing anything you have paid for, and will make your games available to download before we do.

If you got the app from Apple's App Store, the following apply: this agreement is between you and us, not Apple. Apple has no obligation to support or maintain the app. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price; beyond that, Apple has no warranty obligation. We, not Apple, are responsible for product liability claims, claims that the app fails to meet legal requirements, and claims under consumer protection or privacy law. We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights. You confirm you are not in a country subject to a US embargo or listed as a prohibited party. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Similar terms apply to the Google Play Store and to the Google Play Terms of Service.

13. Things you must not do

  • Use the Service for anything unlawful, or to harass, threaten or humiliate someone.
  • Upload content you do not have the right to upload, or content involving a person who has not agreed to be in a game.
  • Upload sexual content, content sexualising a minor, or content promoting violence or hatred.
  • Impersonate someone, or order a game about a public figure or a stranger as if you had their permission.
  • Reverse-engineer, scrape, or interfere with our site, app or servers, or try to get into another person's account.
  • Resell games, accounts or access.

We can suspend or close an account, and refuse or cancel an order, if any of this happens. Where we cancel because you broke these rules, we do not refund.

14. Reviews

Reviews you leave are public, and you give us permission to display and share them, including on our site and in marketing, with the name you entered. Please review honestly; we do not edit reviews to change what they say, and we do not offer payment for positive ones.

15. Warranties and liability

We will provide the Service with reasonable skill and care. Beyond that, and to the extent the law allows, the Service and your game are provided "as is", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or disappointment at a gift not arriving in time. Our total liability to you for any claim is limited to the amount you paid us for the order it relates to.

Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some states do not allow the exclusion of certain warranties or damages, so parts of this section may not apply to you.

16. If you cause us a problem

You agree to cover our reasonable costs, including legal fees, arising from a claim brought against us because of content you submitted, because you did not have the permissions promised in section 9.1, or because you broke these terms.

17. Law and disputes

Talk to us first. Most problems are a misunderstanding and a quick email fixes them. Email support@muksungames.com and give us 30 days to sort it out before starting anything formal.

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute that cannot be settled between us will be brought in the state or federal courts in Clark County, Nevada, and we both agree to those courts having jurisdiction over us.

If you are a consumer outside the United States, this does not take away the protection of mandatory laws in the country where you live, or your right to bring a claim in your local courts where the law gives you that right.

18. The rest

If a court finds part of these terms unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms; we may, if we sell or reorganise the business.

These terms, together with the Privacy Policy and the Refund Policy, are the whole agreement between us about the Service.

We may update these terms. Changes take effect when we post them, and we will change the date at the top. If a change materially affects your rights we will email you before it takes effect. Your order is governed by the terms in force when you placed it.
